What do I do if I'm challenged by an official in the street?

You don't have to be a pedlar to tell us about pedlars that you've seen, what were they selling? Where? Were they doing ok?
Did you kiss them? It's national 'Kiss a pedlar' year of 2018!
<-- Don't kiss him though, yuk!

What do I do if I think I'm trading legally, I've read up and I would have thought that I'd be covered by the pedlars certificate but an official walks up to me and says I'm not allowed to trade here and If I don't go then they are going to seize my gear and I'll get prosecuted and get a fine.
giffgaff seem to be paying 'me' for using 'them' at the moment! Can't get much cheaper than that!

i would say are you a police person ? if not you had better get one because you have no rights to seize my stuff , probably just be pleasant and ask what the problem is , get answer and then pull out some pre prepared paperwork that states my rights ... like this handy one over at pedler.info http://pedlars.info/images/stories/robe ... 1-1881.pdf then ask them if they wouldnt mind walking and talking then probably ;;)

Good advice Lolly and welcome to the forum.

If he was in any of the places listed below, he'd be in for a nasty shock. Quite a few have seizure clauses written into their private Acts. Those that don't have Fixed Penalty Notices. Authorised Council officials (= jobsworths), police constables and PCSOs can effect seizures and issue FPNs.

Check them out:

Liverpool City Council Act 2006 - Street peddling completely forbidden (S)
http://www.legislation.gov.uk/ukla/2006/3/contents/enacted

Leicester City Council Act 2006 - Street peddling completely forbidden (S)
http://www.legislation.gov.uk/ukla/2006/2/contents/enacted

Maidstone Borough Council Act 2006 - Street peddling completely forbidden (S)
http://www.legislation.gov.uk/ukla/2006/4/contents/enacted

City of Newcastle upon Tyne Act 2000 - Street peddling completely forbidden (S)
http://www.legislation.gov.uk/ukla/2000/8/contents/enacted

Medway Council Act 2004 - Street peddling completely forbidden (S)
http://www.legislation.gov.uk/ukla/2004/5/contents/enacted

********************************************************************************************************************
Bournemouth Borough Council Act 2010 - Street pedlary allowed with time and size restrictions. (S)
http://www.legislation.gov.uk/ukla/2010/2/contents/enacted

Manchester City Council Act 2010 - Street pedlary allowed with time and size restrictions. (S)
http://www.legislation.gov.uk/ukla/2010/3/contents/enacted

Canterbury City Council Act 2013 - Street pedlary allowed with time and size restrictions. (FPN)
http://www.legislation.gov.uk/ukla/2013/1/contents/enacted

Reading Borough Council Act 2013 - Street pedlary allowed with time and size restrictions. (FPN)
http://www.legislation.gov.uk/ukla/2013/4/contents/enacted

Nottingham City Council Act 2013 - Street pedlary allowed with time and size restrictions. (FPN)
http://www.legislation.gov.uk/ukla/2013/3/contents/enacted

Leeds City Council Act 2013 - Street pedlary allowed with time and size restrictions. (FPN)
http://www.legislation.gov.uk/ukla/2013/2/contents/enacted

********************************************************************************************************************
Notes:
(S) = Seizure of any relevant goods "if an authorised officer or a constable has reasonable grounds for believing that a person has committed a relevant offence."

(FPN) = " Where ... an authorised officer ... has reason to believe (a person) has committed a relevant offence ... the officer may give ... a notice ... (of) payment of a fixed penalty.

And resisting would get you into a whole load of trouble.

you HAVE to make friends with everyone, then they love you.

The ideal picture of a pedlar is the friendly guy (or gal) selling interesting stuff.

Not the belligerent guy (or gal) trying to squeeze a sale by force of voice :D
